Who we are
Happy Path Apps Ltd, registered in England and Wales, company number 17507113. Registered office: 18 Brookdene Road, Bury, England, BL9 8ND. Email happypathapps@gmail.com. Registered with the Information Commissioner's Office, number ZC279265.
What you're buying
One report on one vehicle, found by the registration you enter. It covers finance agreements, the insurers' write-off register and any category, whether the vehicle is recorded as stolen, keeper changes, plate and colour changes, and whether it's recorded as scrapped, exported or imported. That data is provided by Experian.
The report also shows what Roadworthy shows free for any vehicle, from DVLA and DVSA: tax, MOT status, MOT history and mileage at each test.
The report is a record of what those sources held when you made the check. It isn't an inspection of the vehicle, a valuation, or advice to buy or not to buy. It doesn't cover the vehicle's physical condition or whether it's roadworthy, and it can't show whether a vehicle is a clone carrying another vehicle's identity.
Price and payment
The price is £6.99, including VAT, shown in the app before you buy. You buy it through Google Play, which takes the payment and accounts for the VAT. Google Play's terms also apply.
Getting your report
The report appears in the app as soon as it's ready, and is saved on your phone with the vehicle. Keep it as long as you like. It stays until you choose to delete the report itself: deleting the vehicle from the app doesn't delete it. It's stored only on your phone, so uninstalling the app removes it.
If the check can't be completed, no report is made and we refund you through Google Play. If part of the check doesn't come back, or comes back incomplete, the report says "Not checked" for that part. Tell us and we'll check that part again within a reasonable time and without significant inconvenience to you. If we can't, or don't, we'll reduce the price by an appropriate amount, which may be the full price.
Your right to cancel
For digital content you normally have 14 days to cancel. Before you buy, the app asks you to agree that the report is made straight away and that, once it's delivered, you can no longer cancel. So once your report has been delivered, you can't cancel the purchase.
If something is wrong with your report
The report must be as we describe it here. If it isn't, for example if it's for a different vehicle from the one you entered, tell us and we'll put it right or refund you.
We pass on the records as Experian and its sources give them to us. We don't create them, and we can't check them. If a record is wrong or incomplete, tell us, and we'll pass it on to Experian.
We use reasonable care and skill in supplying your report, but the records in it come from Experian and its sources, and from DVLA and DVSA. We can't promise they're free of errors or complete. If the report isn't as described here, your rights under consumer law apply, and we'll put it right or refund you. Beyond that, our liability to you is limited to the price you paid.
We aren't liable for losses we couldn't reasonably have foreseen, or for events beyond our reasonable control. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't let us limit, and nothing in them takes away your legal rights.
No guarantee
This check comes with no data guarantee: it doesn't insure you against a loss if a record turns out to be wrong. Your rights under consumer law still apply.
Complaints
Email happypathapps@gmail.com with the registration you checked and the date. We'll reply within 5 working days.
The law
These terms are under the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your own courts.
Changes to these terms
The terms that apply to a check are the ones in force on the day you bought it. When they change, the date above changes.
